Terms of Service
1. Welcome to Frens
Frens is operated by Frens Corp., a Delaware corporation. These Terms govern your use of the Frens app, website, and any phone calls placed by our AI personas ("Frens") to the phone number you provide. By creating an account or clicking "I agree," you accept these Terms.
2. Who Can Use Frens
You must be at least 18 years old to create an account and subscribe to Frens. We do not knowingly collect information from, or direct calls to, anyone under 18.
3. Your Account
You are responsible for your account credentials and the phone number you register. Frens will place calls to the phone number on file; update it promptly if it changes. One account per person. Do not share credentials.
4. What Frens Is — and Isn't
Frens provides access to AI-driven voice personas that call your phone on a schedule they learn from you. Your Fren is not a human, not a therapist, not a doctor, not a lawyer, and not a friend in the legal sense. Frens does not provide medical, mental health, legal, financial, or emergency services of any kind. The voice you hear is synthetic and the conversation content is generated by large language models, which can produce inaccurate, unexpected, or inappropriate output.
5. AI Identity Disclosure
You are interacting with an artificial intelligence at all times. You are never talking to a human when you use Frens. We will never represent, suggest, or imply that your Fren is a human.
6. Phone Calls and Your Consent
You provide Frens with your phone number and expressly authorize us to place AI-generated voice calls to that number as part of the Frens service. You confirm this consent at signup (your Prior Express Written Consent, or "PEWC"). Call frequency is configurable and defaults to up to five calls per week, within your quiet-hours window (default 8:00 AM to 9:00 PM in your local time zone). You can change quiet hours, pause calls, or cancel your subscription from your dashboard. You can end any individual call by hanging up. Message and data rates from your carrier may apply. Your consent to receive these calls is part of the Frens service; without it, we cannot provide the service.
7. Recording and Two-Party Consent
Frens may record and transcribe calls to provide the service — including persistent memory, summaries, and quality improvement — and to meet legal obligations. In states with two-party recording-consent rules (including California, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania, and Washington, with nuances in Connecticut, Delaware, and Nevada), your Fren will state a recording notice at the start of each call. You consent to recording by continuing the call. You can request deletion of your recordings from the dashboard, subject to our retention obligations described in the Privacy Policy.
8. Content
Ours. The Frens service, the AI personas ("Luna," "Rat," and others), our system prompts, our software, our branding, and our voice selections are owned by Frens Corp. We grant you a limited, revocable, non-transferable license to use them through your subscription.
Yours. The audio of your voice during calls is yours. You grant Frens a license to process, store, and use it solely to operate the service, including training per Section 12 if you have not opted out. We will not commercialize your voice on a standalone basis — for example, by selling voice clones of you — without your express separate permission.
9. What You Can't Do
Don't use Frens to:
- Abuse, harass, defame, stalk, or threaten anyone.
- Generate child sexual abuse material or content that sexualizes minors.
- Configure a Fren to impersonate a real person, living or deceased, without that person's consent.
- Solicit medical, legal, financial, or emergency advice as if from a human professional.
- Attempt to extract, mirror, or reverse-engineer our AI systems, prompts, voices, or personas.
- Violate any law in your jurisdiction.
10. No Medical, Legal, or Emergency Help
Frens is not a substitute for a licensed medical, mental health, legal, financial, or emergency services professional. If you are in crisis, please call 911 or see our Safety and Crisis Resources. Nothing a Fren says is advice.
11. Subscription, Billing, and Cancellation
Frens is a paid subscription at the price displayed at signup ($9.99 / month at launch). Billing recurs monthly until you cancel. Cancel from your dashboard at any time; cancellation stops future billing and future calls at the end of the current period. Fees already paid are non-refundable except where required by law.
12. AI Training
We may use your call transcripts (not raw audio) to improve our AI safety systems and the quality of our personas. You can opt out of training use from your dashboard. We do not sell your data. We do not share your transcripts with third parties for their own AI training.
13. Service Providers
Frens relies on third-party providers to function, including Clerk (authentication), Stripe (payments), Resend (email), Anthropic and OpenAI (language models), Deepgram and Cartesia (speech services), Telnyx and Daily (telephony), and AWS (hosting). 14. Disclaimers
Frens is provided "as is" and "as available." We make no warranties of any kind, express or implied. The AI personas can produce inaccurate, unexpected, inappropriate, or emotionally intense output; use your judgment. Calls may drop, arrive late, or not arrive at all. We do not guarantee uptime, call quality, or that any particular Fren will be available indefinitely.
15. Limitation of Liability
To the fullest extent permitted by law, Frens Corp.'s aggregate liability for any claim arising out of or relating to these Terms or the service shall not exceed the greater of (a) the total amount you paid Frens in the twelve months before the claim arose, or (b) $100. Frens is not liable for indirect, consequential, incidental, special, or punitive damages.
16. Termination
You can terminate your account any time by canceling your subscription and deleting your account from the dashboard. We can terminate or suspend your access at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or if we discontinue the service.
17. Disputes and Arbitration
Please read this carefully. It affects your legal rights. You and Frens Corp. agree that any dispute arising out of or relating to these Terms or the service will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, in San Francisco, California, and not in court. You and Frens Corp. waive any right to a jury trial. You and Frens Corp. waive any right to bring or participate in a class action, class arbitration, or representative action.
30-day opt-out. You can opt out of this arbitration agreement within 30 days of creating your account by emailing optout@frens.app from the email on your account with a clear opt-out statement. Opting out has no effect on any other provision of these Terms.
18. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. For any dispute not subject to arbitration (for example, small-claims court matters), exclusive venue is the state or federal courts in San Francisco County, California.
19. Changes to These Terms
We may update these Terms. If we make material changes, we will notify you by email and post the updated version here with a new effective date. Your continued use of Frens after changes take effect constitutes acceptance.
20. General
These Terms are the entire agreement between you and Frens Corp. regarding the service. If any provision is held unenforceable, the rest stays in effect. We can assign these Terms to a successor entity in a merger or acquisition; you can't assign them.
